Petitioners approached this Court aggrieved by Ext.P9 order passed by the Additional Tahsildar, Kozhancherry. It is stated in Ext.P9 that petitioners request regarding extent of the property was considered and based on the examination by the District Survey Superintendent, the resurvey record was changed. It is further stated that the files are being approved regarding resurvey in the matter and it can only be changed with the direction of the Court. Petitioners have detailed his grievances in Exts.P6, P7 and P8. Petitioners only issue is regarding the extent of the property.
2. Therefore, identification of the property has to be made out with reference to resurvey records. Necessarily, the extent has to be find out with reference to title deed and survey records. If there are any error in the resurvey with respect to the property claimed by the petitioners, necessarily that has to be corrected. Accordingly, the third respondent shall take appropriate decision within two months after affording an opportunity of being heard to the petitioners.
The Writ Petition is disposed of as above.
