Petitioners approached this Court on account of refusal to receive land tax. The petitioners submit that by virtue of Ext.P1, they are in ownership and possession of the property situated in Survey No.20/1 of Chinnakkanal Village in Udumbanchola Taluk. The Revenue Officials without any reason refused to accept land tax from the petitioners.

In the counter affidavit, it is stated that there is an enquiry initiated against the predecessor-in-interest of the petitioners and it appears that the Patta claimed by the predecessor-in-interest is bogus or forged. It is also submitted that until the enquiry is concluded, the land tax cannot be accepted from the petitioners.
W.P.(C) No.24431 of 2014 2 2. The petitioners point out that land tax has been received till 2006. I am of the view that on account of any enquiry initiated, the right of the petitioners cannot be foreclosed. Therefore, there shall be a direction to respondents 1 and 2 to accept land tax from the petitioners. However, it is made clear that this will be subject to any enquiry initiated against the petitioners' property.
The writ petition is disposed of as above.
