Heard Sri Nitin Chandra Mishra, learned counsel for the petitioner and Sri Sanjay Kumar Srivastava, learned Standing Counsel for the State-respondents.
By means of this writ petition, the petitioner has prayed for the following relief:
I. Issue an appropriate writ, order or direction in the nature of mandamus commanding the respondent no.1 to consider the grievance of the petitioner and direct the private parties to maintain status-quo over the Plot No.95, area 0.319 hectare, situated at Village Ramraipur, Tehsil Bhadohi, District Bhadohi.
II. Issue an appropriate writ, order or direction in the nature of mandamus commanding the respondent no.1 to take appropriate action over the grievance of the petitioner with the help of police force.
Petitioner claims to be bhoomidhari of Plot No.95 area 0.319 hectare and other plots adjacent to Plot No.95 i.e. Plot No.54 and 171 area 1.0270 hectare and 0.4190 hectare respectively.
Learned counsel for the petitioner submits that the private respondents are encroaching over the land of the petitioner.
The dispute raised in this writ petition is purely civil in nature. The petitioner, if so advised, may approach the appropriate forum for redressal of his grievance. In writ proceeding, such dispute cannot be resolved.
Under the circumstances, we are not inclined to interfere in the matter.
The writ petition is, accordingly, dismissed.
