Heard Sri Manoj Kumar, learned counsel for the petitioner. Learned Standing Counsel has accepted notice on behalf of respondent nos.1 and 2. Sri C. K. Rai, learned counsel, has put in appearance on behalf of respondent no.3.
Issue notices to respondent nos.4 and 5 returnable at an early date. Steps be taken within a week.
Sri C. K. Rai, learned counsel on behalf of respondent no.3 contended that the controversy involved in the present case has already been decided by a Full Bench of this Court in Amit Kumar Dwivedi Vs. State of U.P. reported in 2018(4) UPLBEC 3056.
Counter affidavit be filed by all the respondents within six weeks. Rejoinder affidavit may be filed within two weeks' thereafter.
