The instant writ petition is directed against order dated 20.2.2018 passed by the Principal, Dhyanchandra Sports College, Saifai district Etawah, second respondent, whereby the petitioners as well as certain other students have been expelled from the sports college as they had failed to participate in National Level Competition within three years from the date of their admission.
The matter was heard on several dates. Today, when the matter is taken up, Sri H.R. Mishra, learned senior counsel appearing alongwith Sri Ashutosh Tiwari states that the Board of Management of U.P. Sports Colleges Society is in the process of reconsidering its decision relating to participation in National Level Competition within three years. He points out that there is possibility of extension of said period to five years. He very fairly states that until decision is taken by the Society in this regard, the impugned order will not be enforced.
In view of the statement made by Sri H.R. Mishra, the writ petition is disposed of by providing that until the matter is reconsidered by the U.P. Sports Colleges Society, the impugned order shall be kept in abeyance and after decision is taken, it shall abide by such decision.
