THIS CONTEMPT PETITION COMING ON FOR ORDERS THIS DAY, RAVI MALIMATH J., PASSED THE FOLLOWING:
ORDER This contempt petition is filed on the ground that the order dated 23.06.2016 passed by the I Additional City Civil and Sessions Judge, Bengaluru City in P and S.C. No.182 of 2011 has been disobeyed. In terms of the said order, the petition filed under Section 372 of the Indian Succession Act was allowed. Thereafter, since the respondent/accused has not given any death benefits to the complainant herein, the instant petition is filed.
2. After hearing learned counsels, we do not find that any contempt has occurred. The order said to have been disobeyed is an order to the effect that the plea for grant of succession certificate was allowed and succession certificate has been given to the complainant herein. What happens thereafter is not the concern of this Court since, there is no other specific direction in the order dated 23.06.2016. The order is only to grant a succession certificate. Under the circumstance, we find that no contempt arises. The contempt petition is dismissed.
