Heard learned counsel for the petitioners.
This petitioner under Article 226 of the Constitution of India has been filed by Sri Ahish Kumar Lodhi on behalf of his minor son Master Kartikeya (Petitioner No. 1) and minor daughter Km. Saumya (Petitioner No. 2) for directing the opposite party nos. 1 and 2 to produce the petitioners before this Court and they be handed over to his custody.
The submission of learned counsel for the petitioners is that the petitioners are son and daughter of Sri Ashish Kumar Lodhi, whose mother had committed suicide. Thereafter opposite party nos. 1 and 2 who are grand maternal parents of the petitioners came to the house of Sri Ashish Kumar Lodhi and requested to take the petitioners for few days. On their request Ashish Kumar Lodhi permitted them to accompany their maternal grand parents. But thereafter the opposite party nos. 1 and 2 did not permit the petitioners to accompany their father Ashish Kumar Lodhi and they have been illegally detained by opposite party nos. 1 and 2. Therefore, opposite party nos. 1 and 2 be directed to produce the petitioners before the court and they be handed over to the custody of their father Ashish Kumar Lodhi.
Issue notice to opposite party nos. 1 and 2 either to produce the petitioners before this Court on 20.7.2010 or to show cause.
