JUDGMENT / ORDER

Petitioner is aggrieved with Ext. P2 notice for sale. The petitioner contends that the petitioner has not been granted the benefit of “Ashwas - 2014” Scheme, a scheme for one time settlement . It was originally notified as expiring on 31-3-2014 and then the time was extended till 31-6-2014. The petitioner having not produced the scheme herein nor having claimed the benefit of OTS Scheme, within the time stipulated therein, the contention cannot be sustained. 2. The learned counsel for the petitioner contends that the petitioner would settle the amount in instalments. Since the sale is notified tomorrow, the sale shall go ahead, but confirmation W.P. ( C ) No. 34147 of 2014 2 shall be stayed on the petitioner paying an amount of Rs. 50,000/- (Rupees fifty thousand only) within a period of two weeks from today. If the amount is not so deposited, the sale shall be confirmed in the name of the purchaser. The balance amount shall be paid in four instalments for which the bank shall issue statement of accounts showing the dues as on 05-01-2015. The four instalments shall commence on the 18th of January 2015 and followed up on the 18th of the succeeding month. It is also made clear that the petitioner shall also be liable for the charges incurred by the bank in the recovery proceedings. If one single default is committed, the recovery proceedings will revive. If payments are made as directed above, the petitioner shall be issued with a statement for future interest from 05-01-2015, which shall be satisfied as the 5th instalment.
This Writ Petition is disposed of as above.
