Heard learned counsel for the petitioner and Shri Pankaj Rai, learned Addl. Chief Standing Counsel. Shri T.M. Khan appears for Gaon Sabha.
In view of the order proposed to be passed, notices need not go to private respondents.
The petitioner is before this Court for a direction to first respondent to decide Appeal No.C-2005050000360 (Habibulla v. Asgar (deceased) & Ors.) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of finally with a direction to first respondent to consider and decide the aforesaid appeal in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost of Rs.250/-.
