Heard learned counsel for the applicant as well as learned A.G.A. for the State of U.P and perused the material available on record.
By way of the instant application, the applicant seeks bail in Case Crime No. 148 of 2014, under Sections - 420, 406, 504, 506 I.P.C., Police Station - Pakwada, District - Moradabad.
Applicant claims to have been falsely implicated in this case. He happens to be a daily wager and he has not committed any offence. There is lot of shortcomings in the investigation. There is no credible evidence appearing against the applicant to connect him with the offence in question. Offence alleged is triable by the Magistrate Ist Class.
Per contra, learned A.G.A. has submitted that in this case, the applicant maliciously and deceitfully obtained Rs.4,10,000/- for earning employment for the informant side and by way of agreement dated 17.7.2013, he agreed to pay back the entire money, however, he returned only Rs.70,000/- and Rs.3,40,000/- remains to be paid.
Considered the rival submissions and perused the material brought on record. No good ground is made out for bail.
Accordingly, the instant bail application is rejected, at this stage.
It is made clear that the observation made in this order shall not be construed to have any reflection on merit of the case.
