JUDGMENT / ORDER

The petitioners filed an appeal challenging the consent issued to the first respondent before the third respondent- Air Appellate Authority, Thiruvananthapuram. The appeal was numbered as Appeal No.21/2011. This appeal has been disposed of on 16/10/2014 vide Ext.P4 holding that the matter has become infructuous as the period of validity of the consent has already been expired on 30/6/2012. 2. The learned counsel for the petitioners as well as the learned Standing counsel for the respondent Board submits that the consent issued to the first respondent has been renewed and the validity of the consent would expire only on 30/6/2015. In view of the above submission, it cannot be said that the matter has become infructuous as the right of renewal would depend upon the original consent issued to the first respondent.

3. In the light of the above, I am of the view that Ext.P4 is liable to be set aside. Accordingly, Ext.P4 is set aside. There shall be a direction to the 3rd respondent- Air Appellate Authority to restore Appeal No.21/2011 to file and dispose of the same, after hearing the petitioners and the first respondent, within a period of three months from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
