This Criminal Misc. Application under Section 482 Cr.P.C. has been filed with the prayer to direct the courts below to dispose of the bail application of the applicant on same day in case crime no. 169 of 2009, under Sections 498A, 323, 504, 506 IPC and ¾ D.P. Act, P.S. Colonelganj, District- Allahabad.
Heard learned counsel for the applicant and learned A.G.A. and perused the record.
Learned counsel for the applicant submitted that it is a no injury case, during investigation arrest of the applicant was stayed and the Criminal Writ Petition was filed, co-accused has already released on bail. The prayer is for consideration of the bail application, expeditiously, preferably on the same day.
In view of the fact of the present case, it is provided that if applicant appears and surrenders before the courts below and apply for bail within three weeks from today, then the prayer for bail shall be considered, as expeditiously as possible in accordance with law, in view of the law laid down by the Full Bench of this Court in the case of Amrawati and another Vs. State of U.P. reported in 2004(57) ALR 390 and affirmed by Hon. Apex Court in Lal Kamlendra Pratap Singh Vs. State of U.P. and others 2009(2) Crime 4 SC after affording the opportunity to the public prosecutor.
