JUDGMENT / ORDER

The petitioner has suffered an ex-parte decree for recovery of possession and injunction in O.S. No. 5/2013 on the file of the court of the Munsiff of Peermade. The petitioner has however filed an application for setting aside the ex-parte decree supported by an application for condonation of delay. The petitioner has filed an application to set aside the order making him ex-parte in the execution proceedings as well.
2. I direct the court of the Munsiff of Peermade to consider the applications for setting aside the ex-parte decree and condoning delay in O.S. No. 5/2013 on its file. Every endeavour shall be made to pass final orders thereon within a period of one month from the date of production of a copy of this judgment. Further proceedings in E.P. No. 5/2014 for delivery of the property covered by the decree shall be put on hold till orders are passed on the application for setting aside the ex-parte decree as directed above.
The Original Petition is disposed of.
