The prayer made in the instant petition is for issuing direction to the trial court to decide the application for temporary injunction paper no. 28-C filed by the defendants-petitioners in Original Suit No. 53 of 2014 within a specified time frame.
It is noteworthy that the defendants after filing of application 28-C had filed a counter claim along with the written statement. The trial court by order dated 30.04.2019 observed that since the said application is still pending and, therefore, it deserves to be decided before proceeding any further in the matter. However, according to learned counsel for the petitioners the said application has not been decided so far.
Accordingly, the instant petition is disposed of with direction to the trial court to make serious endeavour to decide the said application expeditiously preferably within a period of eight weeks from the date of production of certified copy of this order, provided there is no legal impediment.
