JUDGMENT / ORDER

Petitioner is the owner and in possession of a property situated in Survey No.361 of Thekkumbhagam Village in Kanayannur Taluk. This property is classified as nilam in BTR. Petitioner has approached this Court seeking a direction to the District Collector to grant permission to utilise the land for other purposes under the Kerala Land Utilisation Order. According to the petitioner, this property is a dry land and planted with coconut trees and other trees. On instructions, the learned Government Pleader submits that this property is classified as paddy land in draft data bank. In view of the above it is not proper to direct the District Collector to consider the application filed by the petitioner. However, the petitioner has a remedy to approach the local level monitoring committee if the petitioner has a case that this property is converted much

2 before the Act 28 of 2008. If the petitioner moves such an application within two weeks from the date of receipt of copy of this judgment, the local level monitoring committee shall conduct a site inspection in the presence of the petitioner and to find out this property can be classified as nilam as on the date of enactment of Act 28 of 2008. If it cannot be classified as paddy land as on the date of enactment of Act 28 of 2008, necessary changes shall be effected in the draft data bank. Needful shall be done within six weeks from the date of receipt of the application from the petitioner.
Writ petition is disposed of as above.
