Madras High Court|04 October, 2017

JUDGMENT / ORDER

With the allegations of abusing and misusing the powers by the fourth respondent viz., Sub-Inspector of Police, Arakonam Taluk Police Station, Vellore District, the petitioner has filed the present petition seeking for a direction to the first respondent to take action against the fourth respondent by representation dated 20.09.2017 sent by Fax.
2. In my view, such representation need not be considered by the first respondent and appropriate authority is to consider the petitioner's representation and to issue direction to the third respondent herein viz., Superintendent of Police, Vellore District.
3. In view of the limited prayer sought for and without making any observation with regard to the petitioner's allegation in the representation already made, the petitioner is granted liberty to make appropriate representation before the third respondent seeking for such relief.
4. On receipt of the representation from the petitioner, the third respondent, viz., Superintendent of Police, Vellore District, shall pass appropriate order on its own merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. It is made clear that I have not expressed any of my views with regard to the merits of the case.
With the above observation, Criminal Original Petition stands disposed of.
