JUDGMENT / ORDER

Ashok Bhushan, Ag.CJ
Heard learned counsel for the petitioner and the learned Government Pleader. No notice is being issued to the 2nd respondent in view of the judgment being passed today.
2. Petitioner's case is that the 2nd respondent is violating the injunction order dated 09/10/2014 in A.S.No.77/2014 which has been granted in favour of the petitioner restraining the 2nd respondent from trespassing into her property. On a complaint made by the petitioner in this regard, 1st respondent has registered Crime No.1140 of 2014 against the 2nd respondent in addition to Crime No.1350 of 2014 registered on an earlier complaint filed by the petitioner. As far as violation of interim injunction is concerned, remedy of the petitioner is to file a petition under Order 39 Rule 2A of the Code of Civil Procedure. As far as any offence committed by the 2nd respondent is concerned, the complaint of the petitioner, Ext.P5 shall be looked into by the 1st respondent and appropriate action shall be taken in accordance with law.
With the above observation, this writ petition is disposed of.
