JUDGMENT / ORDER

THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.6488 of 2006 Between:
Marine Fishermen Co-operative Society, Rep. by its president K. Srinivasulu PETITIONER AND
1. The managing Director, The Oriental Insurance Company Ltd., Oriental House, P.B.No.7037, A-25/27, Asaf Ali Road, New Delhi, and another.
RESPONDENTS ORDER:
This writ petition is filed under Article 226 of the Constitution of India, seeking the following relief.
“….to issue writ, order or direction particularly one in the nature of writ of mandamus by declaring the inaction of respondents in settling the claims of family members of fishermen belonging to petitioner society who died on 26.12.2005 due to Tsunami disaster despite representations dated 15.10.2005, 26.12.2005 and letter of confirmation of payment of premium by Joint Director of Fisheries dated12.12.2005 as illegal and arbitrary and direct the respondents to settle their group insurance claims with immediate effect…….”
2. When the matter is called today, it is represented by the learned counsel for the respondents that the claims of the writ petitioner are repudiated by the company, as such, nothing survives in the writ petition for adjudication.
3. Recording the said submission, the writ petition is dismissed as infructuous. No order as to costs. As a sequel, miscellaneous petitions, if any, shall stand closed.
