Heard learned counsel for the petitioner; learned A.G.A. for the respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 02.06.2019 registered as Case Crime No.184 of 2019, under Section 135 of Electricity Act, P.S. Fatehpur, District Saharanpur.
The allegation made in the impugned first information report discloses abstraction of electricity directly and to stop the meter, its outgoing cable has been cut.
As the FIR discloses commission of cognizable offences, the prayer of the petitioner to quash the first information report cannot be accepted. The petition is dismissed without prejudice to the right of the petitioner to seek for bail/anticipatory bail or compounding of the offence, as may be advised.
