ORDER:
Heard learned counsel for the petitioner and learned Government Pleader.
2. Petitioner claims that he is the owner and possessor of an extent of 200 sq. yards of land in Sy.Nos.663 and 665 at Mahaboobabad Gram Panchayat and Mandal, Warangal District. Petitioner placed reliance upon a registered sale deed dated 26.04.2010. Petitioner, however, claims that plot No.40, which falls within the said two survey numbers, is sought to be claimed by the Government as the land, abutting to the aforesaid patta land, bearing Sy.Nos.534, 535, 663 and 665 was already used for laying of railway track and no more Government land is available. Petitioner claims that the third respondent and his subordinates are trying to dispossess him. Hence, the present writ petition is filed.
3. Learned Assistant Government Pleader, who has secured instructions, submits that though the land in Sy.No.663 is patta land, the land in Sy.No.665 is Government land. It is, however, stated by the Tahsildar, under instructions, that they are not proposing to assign or enter into the said land and that they will follow due process of law, if any action is necessary in future.
4. In view of the said instructions, since no interference is being caused by the official respondents, as alleged by the petitioner, no further orders are necessary in this writ petition.
The writ petition is accordingly disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
