JUDGMENT / ORDER

The petitioner is aggrieved with the non-consideration of the appeal and the interim application filed as per Ext.P4 The learned Standing counsel appears and submits that even the appeal number is not mentioned. The learned counsel for the petitioner however would contend that the Tribunal presently does not have a Presiding Officer and the petitioner has sent the appeal by post to the Appellate Tribunal at New Delhi and have not yet received the number. Especially considering the fact that the matter was once remanded and again an appeal was filed the petitioner would be granted a stay on condition of deposit of 30% of the amount within a period of one month from today. Further recovery shall depend upon the orders passed in the appeal filed by the petitioner before the Appellate Authority. Writ petition is disposed of.
