TO BANGALORE AND BACK, AND TO CONSIDER THE SAME FORTHWITH.
THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R The petitioner has sought for a writ of mandamus directing the respondent to consider the application/ representation dated 12.09.2018 for the deletion of the condition imposed by the respondent in as much as the appellant not to operate the route between Kolar to KGF till the orders in W.A.No.5093-99/97 are in force/continued in connection with permit No.03/2000-2001 valid till 14.11.2020 for the route K.G.F. to Bangalore and back.
2. The petitioner is aggrieved by the inaction of the respondent in not taking a decision on the application/representation filed by him for the deletion of the condition imposed in the permit, albeit several requests being made.
3. It is obligatory on the part of the respondent to consider the representation dated 12.09.2018 submitted by the petitioner in accordance with law. The same having not been done, the respondent is directed to consider the representation of the petitioner dated 12.09.2018 at Annexure-B to the writ petition and shall take a decision in accordance with law in an expedite manner, in any event, not less than 12 weeks from the date of receipt of certified copy of the order.
With the aforesaid observations and directions, the writ petition stands disposed of.
