Relying on the judgments of the Hon'ble Supreme Court reported in AIR 2003 SC 4548 in the case of R.V.E. Venkatachala Gounder V. Arulmigu Viswesaraswami and another and also reported in AIR (2008) 8 SCC 564 in the case of K.B.Saha and Sons Private Ltd. v. Development Consultant Ltd., Mr.M.M. Saiyed, learned advocate for the petitioner argued that the unregistered document is given exhibit which is not being pressed into service for collateral purpose, the order exhibiting the same, in such circumstances, as also without the proof of such document, is contrary to the settled position of the law.
Issue notice to the Respondent Nos.2 and 3 by RPAD post and qua respondent no.1, direct service is permitted, returnable on 05.04.2012.
