Both the parties are present before this Court and they have been identified by their respective counsels and they have also put their signatures on the order- sheet of this Application.
Heard learned counsel for the applicants, learned counsel for the opposite party No.2 and the learned A.G.A. for the State- respondent.
The present 482 Cr.P.C. application has been filed to quash the order dated 25.02.2019 passed by C.J.M., Lalitpur in Case No.5135 of 2018 arising out of Case Crime No.265 of 2018, under Sections 363, 366 IPC, P.S. Talbehat, District Lalitpur.
Learned counsel for the applicants has engaged attention of this Court on para nos.-4 and 5 of the counter affidavit filed in support of this application, wherein it has been specified categorically that the dispute has been settled between both the parties out of the court and they have resolved their differences amicably.
Learned counsel for respondent no.2 also does not dispute the fact of compromise and has stated that in view of the compromise, he does not want to pursue the matter any further.
Learned AGA does not dispute the submissions made by learned counsel for the applicants and he has no objection, if this application is allowed and the proceedings are quashed.
The dispute has been amicably settled between the parties, no useful purpose would be served in keeping the application pending.
Thus, in view of above, impugned order dated 25.02.2019 passed by C.J.M., Lalitpur in Case No.5135 of 2018 arising out of Case Crime No.265 of 2018, under Sections 363, 366 IPC, P.S. Talbehat, District Lalitpur, is hereby quashed.
The instant application is, accordingly, allowed.
Let a copy of this order be sent to the court below for necessary information and follow up action.
