Heard learned counsel for the petitioner, learned Standing Counsel for the respondent nos. 1, 2 & 4 and Sri A.K. Yadav, learned counsel for respondent no. 3.
Learned counsel for the petitioner submits that petitioner appeared in Assistant Teacher Recruitment Examination, 2018. Result of petitioner was declared in which he has given 58 marks and declared not qualified. It is next submitted that 8 questions are wrongly evaluated and in case those questions are re-evaluated and marks are given, petitioner would be qualified in the said examination. Lastly, he submitted that a direction may be issued to respondent no. 4 to recheck the answer book of petitioner and award marks to petitioner on those questions.
Learned standing counsel submitted that petitioner had obtained only 58 marks and if in all 8 questions marks is awarded to the petitioner even though he would not obtain 67 qualifying marks. It is next submitted that by the perusal of question papers, model answer book and answers given by the petitioner, it appears that except one or two questions, all the questions are properly evaluated and no marks can be awarded to the petitioner in those questions.
I have perused the question papers, model answer book and answers given by the petitioner and prima facie, answers given by the petitioner in question nos. 64, 84, 112, 121, 122, 125, 138 and 139, some answers appear to be correct, therefore, under such facts and circumstances, respondent no.4 is directed to recheck the answer book of the petitioner within two months from the date of production of certified copy of this order and provide result to the petitioner after rechecking the answer book within the same time.
With the aforesaid observations, the writ petition is disposed of. Order Date :- 30.9.2019 Sartaj
