JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to attend the marriage in the family.
Pursuant to the earlier order passed by this Court, learned APP, Mr.Pandya, based on the report of Pethapur Police Station, has submitted that ground mentioned in the application is genuine.
From jail remarks, we find that except last occasion, whenever the applicant-convict was enlarged on temporary bail or on furlough, he has surrendered to the jail authority in time.
Considering the totality of the facts, it is ordered that applicant-convict shall be enlarged on temporary bail for a period of 1 week from the date of his actual release on personal bond of Rs.5,000/- with one surety of the like amount and with the further direction that the applicant shall surrender to the jail authority on expiry of the period granted by this Court.
Application is allowed to the aforesaid extent. Rule made absolute.
