1. The learned Counsel for the appellant, Mr. Bhatt, states that the conviction of the present appellant is of one year.
2. Learned Special Public Prosecutor for respondent No.1-State, Mr. Panchal, and learned Counsel for respondent No.2-S.I.T., Mr. Kogze, state that the other co-convicts, who have been convicted for the offence under Section-307 of the Indian Penal Code and sentenced to undergo life imprisonment, have uptil now not preferred any appeal. It is, further, stated that so far as CR.A/1461/2012 2/2 ORDER present appellant is concerned, the State is in contemplation of filing appeal against the acquittal and also for enhancement of the sentence and the said process is going on.
3. It may be be noted that the present matter arise from the judgment delivered by the Special Designated Court pertaining to riot cases in which the direction was given by the Apex Court.
4. Under the circumstances, office to examine as to whether it would be a matter to be placed before the learned Single Judge or before the Division Bench and if so required, after obtaining necessary orders from Hon'ble the Chief Justice on administrative side, this matter be listed before the appropriate Court, preferably on 28TH SEPTEMBER, 2012.
