JUDGMENT / ORDER

~ ~ ~ ~ ~ ~ Petition under Section 438 Cr.P.C. 2. Petitioner is the second accused in Crime No.1036/2014 of Kaduthuruthy Police Station registered for the offence punishable under Section 392 read with Section 34 IPC.
3. The allegation against the petitioner is that on 28.08.2014 at 3.45 p.m. he was riding a motor bike with A1 as pillion rider with intend to commit robbery and while so, the first accused snatched away a gold chain and locket weighing 3 grams worn by a lady, who was a pedestrian. The 1st accused was arrested on 31.08.2014 while he was riding on the motor bike with a fake registration number. The petitioner could not be arrested as he was absconding after the arrest of A1.

4. Heard learned counsel for the petitioner and learned Public Prosecutor.
5. The contents of the CD, prima facie, reveal the complicity of the petitioner. The custodial interrogation of the petitioner is required as the presence of the petitioner is required, mainly for the purpose of identification. Considering the seriousness of the allegations against the petitioner and the present stage of investigation, I am of the view that this is not a fit case wherein anticipatory bail can be granted to the petitioner.
In the result, this Bail Application is dismissed.
