This Criminal Petition is filed under Section 438 Cr.P.C praying to enlarge the petitioner on bail in the event of his arrest in Cr.No.116/2017 of Annapoorneshwari Nagar Police Station, Bengaluru City, which is registered for the offences p/u/s 364(A), 384, 324 r/w 149 of IPC.
This criminal petition coming on for Orders this day, the court made the following:
O R D E R Heard the learned counsel for the petitioner and the learned High Court Government Pleader for the respondent-State.
2. The petitioner apprehends arrest by the respondent police in their Crime No.116/2017 in respect of the offences punishable under Sections 364(A), 384, 324 r/w 149 of IPC.
3. During the pendency of the petition, the chargesheet is said to have been submitted to the Court by showing the petitioner as absconding accused.
4. Learned counsel for the petitioner submits that the petitioner is innocent of the offence, he is not a local person and he is from Kunigal.
5. In the light of the fact that he is shown as absconding accused and NBW order is sought from the Court in the chargesheet, it is not appropriate to consider the petition on its merits.
6. Hence, the petition is rejected. In the event, petitioner serves advance copy of the bail application to the concerned Public Prosecutor, surrenders and moves necessary application, his application shall be considered in accordance with law in the light of the bail granted to the co-accused by this Court.
