Heard Sri Balbeer Singh, learned counsel for the applicant, Ms. Manju Thakur, learned counsel for the complainant and learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the applicant had not enticed away the victim girl and the persons of the locality had made a false complaint against him. He has been falsely implicated in the present case.
Learned A.G.A. has vehemently opposed the prayer for bail and submitted that the victim is a minor girl aged about 15 years. She has been rescued by the police on receiving information on 100 dail.
Without expressing any opinion on the merits of the case and considering the submission advanced, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicant Manu @ Manish involved in Case Crime No. 629 of 2019 under sections 363, 366 I.P.C., police station Tajganj, District Agra.
Accordingly, the anticipatory bail application is rejected.
However, the applicant will be at liberty to move regular bail application under section 439 Cr.P.C., if so advised.
