The instant contempt petition has been filed for violation of order dated 12.03.2012 passed by the Civil Judge (Junior Division) Gautam Budh Nagar in respect of disputed property. By the said order, the parties were directed to maintain status quo.
It is urged by learned counsel for the applicant that the opposite parties have demarcated the disputed property and handed over possession to the sixth respondent (defendant).
I have heard learned counsel for the applicant at length and perused the material brought on record, in particular the communication dated 07.05.2018 written by the sixth respondent and addressed to the Sub Divisional Magistrate, Sadar, for demarcation of the property which is covered through wire fencing belonging to the Air Force Naval Housing Board. Threat of encroachment by the farmers and the land grabbers was apprehended.
Be that as it may, serious disputed question of facts are involved which cannot be gone into in contempt jurisdiction.
Learned counsel for the applicant submits that the applicant would be satisfied in case the contempt petition is disposed of as withdrawn with liberty to the applicant to take appropriate remedy before the civil court.
In view thereof, the contempt petition is disposed of as withdrawn with the aforesaid liberty.
