… Respondents THE HON’BLE SHRI JUSTICE SANJAY KUMAR WRIT PETITION NO.22547 OF 2004 O R D E R The petitioners claim to have purchased various extents of land in Sy.No.60/4 of Kurmannapalem Village, Hamlet of Vadlapudi, Visakhapatnam, under registered sale deeds. Their grievance in the present writ petition was that the respondents were attempting to forcibly dispossess them and demolish their structures in the subject lands without issuing any notice or giving them an opportunity of hearing.
This Court, at the time of admission of this case on 08-12-2004, directed status quo existing as on that day to be maintained. No counter-affidavit has been filed by the first respondent or the State.
As the petitioners claim interest in the subject lands on the basis of registered deeds of conveyance, they would necessarily have to be put on notice and be given due opportunity of hearing in the event the authorities wish to proceed against the lands covered by the said documents. As the short grievance of the petitioners is that the authorities did not take recourse to this procedure, the writ petition is amenable to disposal with the following order.
The respondents shall not dispossess or interfere with the possession of the petitioners over the subject lands except in accordance with the due procedure laid down by law. The writ petition is accordingly disposed of. No order as to costs.
