Heard Sri G.S. Srivastava, learned counsel for the petitioner and Sri Alok Kumar Yadav, learned counsel who put appearance on behalf of all respondents.
Admittedly, the Original Suit no.6 of 2015 is pending before the Civil Judge (Junior Division) Jewar, District Gautam Budh Nagar.
The petitioner’s application being application no.15C2 has been rejected by the Civil Judge (Junior Division), Jewar, Gautam Budh Nagar vide the order dated 03.08.2018 against which the petitioner has approached the District Judgte, Gautam Budh Nagar by means of Misc. Civil Appeal No. 27 of 2018, the said miscellaneous appeal was rejected by learned District Judge vide the order dated 18.02.2019.
The submission of learned counsel for the petitioner is that since the temporary injunction application is rejected by the learned Civil Judge (Junior Divison) the petitioner has an apprehension that the property in dispute may be sold out by respondents or the possession of the petitioner may be disturbed.
Having heard the learned counsel for the parties and with the consent of learned counsel for the parties, the writ petition is disposed of by directing the Civil Judge (Junior Division) Jewer, District Gautam Budh Nagar to expedite the proceeding and dispose of the pending suit expeditiously, preferably within a period of three months from the date of production of certified copy of this order, strictly in accordance with law without granting any unnecessary adjournment either of the parties With the above observation, the petition is disposed of.
