Heard learned counsel for the applicant Manorath alias Vijai Prakash and learned AGA for the State.
Accused applicant has applied for bail in Case crime No.374 of 2010 u/s 363,366 IPC P.S.Rampur District Jaunpur.
It is contended on behalf of the accused- applicant that he is uncle of co- accused Umesh Kumar. He has nothing to do with the alleged kidnapping of Payal. As per FIR Payal, the victim herself is aged about 21 years and student of B.A. IIIrd year. That the applicant is living separately. The arrest of Umesh Kumar co-accused has been stayed by Division Bench of this Court vide order dated 8.6.2010.
Considered the submissions made by learned counsel for the parties and keeping in view this fact that the arrest of main accused Umesh Kumar had already been stayed by Division Bench of this Court and applicant is uncle of the main accused, without expressing any opinion on the merit of the case, I am of the view that the applicant is entitled to be enlarged on bail.
Let the applicant Manorath alias Vijai Prakash involved in the above case crime be released on bail on his executing personal bond and furnishing two sureties each in the like amount to the satisfaction of Court concerned.
