Heard learned counsel for the petitioner and learned Standing Counsel.
Although, this petition challenges an order dated 1 October 2018 in terms of which the prayer of the petitioner for transfer from Mau to Ghazipur has come to be rejected, the Court is informed that the husband of the petitioner has succumbed to his injuries and died on 24 August 2018. The initial prayer for transfer to Ghazipur was addressed on account of the fact that the petitioner was constrained to seek transfer from Mau to Ghazipur in order to look after her husband. The prayer for posting at Ghazipur is reiterated since according to the petitioner, it is her home district and in view of the personal tragedy suffered, her prayer for transfer to Ghazipur be attended to and disposed of.
Learned Standing Counsel on instructions states that notwithstanding the order dated 1 October 2018, the prayer of the petitioner for posting at Ghazipur shall be duly attended to and disposed of by the respondent No.2 in accordance with law and preferably within a period of one month from today.
The writ petition is disposed of in light of the statement as noted above.
