Heard learned counsel for the petitioner.
Appeal No.102 of 2008 (Kaushilya Devi and others Vs. Manorama and another) arising from the judgment and order dated 16.2.2008 deciding Suit No.1241 of 2000 (Smt. Kaushilya Devi and others Vs. Manorama Devi and another) and Suit No.1140 of 2000 (Manorama Devi Vs. Kaushilya Devi and others) is pending in the Court of Additional District Judge, Azamgarh.
Petitioner has filed this petition for direction upon the court concern to decide the aforesaid appeal within a time bound period.
In view of the general mandamus of the Division Bench of this court in Ayodhya Sahai Vs. District Judge, Jaunpur and others (1997) 3 UPLBEC 1677 and looking to the fact that the appeal is of the year 2008, the petition is disposed of with the direction to the court concerned to decide the same in accordance with the law as expeditiously as possible preferably within a period of one year from the date of production of the certified copy of this order, provided there is no legal impediment.
