In compliance of the order dated 22.02.2018, learned counsel for the petitioner has filed a supplementary affidavit bringing on record the Government Order dated 10.06.1985 wherein it has been provided in clause (5) that there is parity in the pay-scale regarding the Medical and Para Medical staff working in the Labour Department with the similar staff working with the Health and Medical Department of the State Government.
Heard learned counsel for the parties.
The grievance of the petitioner is that the petitioner is working on the post of Health Visitor but not being paid salary, other allowances as per the payment being made to the Medical and Para Medical staff of the Health and Medical Department. Petitioner is working in the Employees State Insurance Labour Medical Services, Uttar Pradesh and therefore, is being discriminated. As per the Government Order dated 10.06.1985 brought on record before this Court, parity in pay and allowances have been granted to the Medical and Para Medical staff of the Labour Department vis-a-vis the State Government Medical and Health Services.
In view of the above, this writ petition is disposed of directing respondent no.1, Director, Employees State Insurance Labour Medical Services, Uttar Pradesh, Lucknow to consider the grievance of the petitioner in the light of the Government Order dated 10th June, 1985 and pass appropriate orders in accordance with law within a period of six weeks from the date of production of a certified copy of this order before respondent no.1.
