The prayer made in the instant petition is for issuing direction to the trial court to decide Misc. Case No. 224/74 of 2019 arising out of Original Suit No. 2297 of 2011 within a specified time frame.
The petitioner, who was not party to the suit claims to have filed an application under Order 9 Rule 13 CPC for setting aside the judgement and decree dated 22.8.2013 passed in the suit. The petitioner has also prayed for a direction to the respondents not to dispossess her from the suit property.
Having regard to the entire facts, the instant petition is disposed of with direction to the court below to decide Misc. Case No.224/74 of 2019 expeditiously by fixing short dates and without granting unnecessary adjournments soon after all the opposite parties therein are duly served. It shall be open to the petitioner to make prayer for stay of her dispossession before the court before which Misc. Case No.224/74 of 2019 is pending or in the execution proceedings.
The petition stands disposed of accordingly.
