1. In view of the contentions raised referring to the various orders, including the order passed by the Division Bench of the High Court at Annexure-A and also considering the fact that alternative arrangement has been made as referred to in Annexure-H, the matter requires consideration, when different rounds of litigation before the High Court has decided the issue with regard to the implementation of Town Planning Scheme. Hence, the following order:

RULE returnable on 27th November, 2012. Learned APP Mr. H.L.Jani waives service of Rule for Respondent No.2-State of Gujarat.

2. Ad-interim relief in terms of paragraph 25(C) is granted till then.
