JUDGMENT / ORDER

The petitioner has purchased a stage carriage vehicle from the third respondent. The third respondent was covered under the Employees Provident Fund and Miscellaneous Provisions Act, 1952 and hence no contributions were paid under the Kerala Motor Transport Workers' Welfare Fund Act, 1985, by virtue of a specific exemption provided in the latter Act. Now, the petitioner having taken up the stage carriage, does not have the requisite employees to be covered under the Employees Provident Fund and Miscellaneous Provisions Act, 1952. The petitioner contends that he would take registration under the Kerala Motor Transport Workers' Welfare Fund Act and proceed with the future contributions as per the said Act. In such circumstances, the first respondent shall consider the prayer for registration under the Kerala Motor Transport Workers' Welfare Fund Act, 1985 within a period of two weeks from today. The writ petition is disposed of.
