Heard Shri Ajay Kumar Mishra, learned counsel for the petitioners and learned standing counsel for the State - respondents.
This writ petition has been filed for quashing the recovery citation issued by the Tesildar, Mawana, District - Meerut (respondent no. 2).
A perusal of the record indicates that the recovery is being made in pursuance of the order passed by the court of Additional Sessions Judge/Fast Track Court No. 3, Meerut under section 446 Cr.P.C.
The petitioners are not challenging the merit of the order dated 21.05.2019. The petitioners are ready to deposit the amount sought to be realized by the Court of Additional Sessions Judge/Fast Track Court No. 3, Meerut. At present, the petitioners requires some easy installments be fixed for depositing the aforesaid amount.
Accordingly, the writ petition is disposed of giving liberty to the petitioners to deposit the entire outstanding dues in four equal 3rd monthly installments. The first installment shall be deposited on or before 22.07.2019 and thereafter, all the other three installments shall be deposited on or before three months.
In case the petitioners commit any default, the interim protection granted to them shall stand automatically vacated.
