Petitioner is accused in Crime No.109 of 2014 of the Excise Range Office, Mananthavady for the offences punishable under Section 8(1) & (2) of the Kerala Abkari Act for alleged possession of 2 liters of arrack, is in custody from 02.05.2014 and seeks bail. 2. I have heard the learned Public Prosecutor and the learned counsel. Petitioner is not reported to be involved in any other case from the Excise Range Office, Mananthavady. Final report is filed in the Judicial First Class Magistrate's Court-II, Mananthavady on 02.05.2014.
3. In the above circumstances I am inclined to think that further custody of the petitioner is not required. Hence I am inclined to grant bail but subject to conditions.
The application is allowed as under :
I. Petitioner is granted bail in Crime No.
109 of 2014 of the Excise Range Office, Mananthavady and shall be released (if not required to be detained otherwise) on his executing bond for `25,000/- (Rupees twenty five thousand only) with two sureties for the like sum each to the satisfaction of the Judicial First Class Magistrate Court-II, Mananthavady and subject to the following conditions:
a. One of the sureties shall be a close relative of the petitioner.
b. Petitioner shall report to the officer who has investigated the case if and when required for investigation.
c. Petitioner shall not get involved in any offence during the period of this bail.
d. Petitioner shall not intimidate or influence the witnesses.
e. In case any of condition Nos.(b) to (d) is violated, it is open to the investigating officer to file application before the Judicial First Class Magistrate Court-II, Mananthavady until committal of the case if any, and thereafter before the Principal Sessions Judge concerned for cancellation of the bail granted hereby, as held in P.K.Shaji v.State of Kerala [AIR 2006 SC 100].
