(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Mr.Desai, learned advocate for the Official Liquidator, places on record report of the Official Liquidator dated 28.06.2008 whereby in Paragraph No.10 it has been stated that as against the offer of Rs.1.03 crores of the applicant in 2002, the Official Liquidator has been informed that one M/s. SMDT Enterprises has offered Rs.8 crores and EMD of Rs.1 crore is also deposited by the said interested offerer. The Official Liquidator has no objection in refunding the amount.
Mr.Amitkumar, learned counsel appearing with Mr.Vin, and Mr.Bhatt, learned counsel, state that they want time to meet with the said aspect.
It prima facie appears to us that while considering the present review application we may be required to also examine the merits of O.J. Appeal No.81 of 2004 simultaneously. As per the present roster the said business is not assigned to this Court, unless there are specific orders for such purpose by the Hon'ble the Acting Chief Justice. Hence, office to place the matter before the Hon'ble the Acting Chief Justice and place the matter before the Bench as may be ordered by the Hon'ble the Acting Chief Justice on administrative side, preferably on 06.07.2012.
