Heard Shri Devendra Saini, learned counsel for petitioner and learned A.G.A. for State of Uttar Pradesh.
This writ petition has been filed for quashing the F.I.R. dated 11.11.2017 registered as Case Crime No. 1274 of 2017, under Sections 420, 406, 120-B, 34 I.P.C. & 3, 4, 5, 6 of the Prize and Chits Money Circulation Scheme Banning Act 1978 & 66(C), 66(D) Information Technology Act, Police Station- Sikandra, District- Agra.
A perusal of F.I.R. shows that in substance the allegation has been made that Pay Way I.T. Solution Pvt. Ltd. committed the fraud of Rs. 13,80,000/- from the informant Yashpal Singh and later on office was closed and its whereabouts is not traceable.
Counsel for the petitioner admitted in paragraph nos. 6 and 7 of the writ petition that the petitioner was doing a job as a representative in the aforesaid company and his job was only to advertise the scheme of the company to promote the investment by the investors.
The involvement of petitioner in the act of chitting, cannot be ruled out at this stage. The petition has no merit.
