JUDGMENT / ORDER

The petitioner was one of the bidders at an auction that was conducted by the Thrissur Municipal Corporation for the right to conduct a canteen in the Sakthan Thampuran Bus Stand. It was confirmed in favour of the highest bidder. The petitioner was only the third highest bidder. According to the petitioner, the auction had taken place in the year 2010. The petitioner has now been issued with Ext.P7 notice, directing him to show cause why action should not be taken against him for recovery of an amount of ₹5,18,000/- being the loss suffered by the Corporation by reason of the petitioner backing out from his bid. 2. Adv.K.P.Vijayan appears for the Corporation. Heard. A perusal of Ext.P7 shows that the same is only a show case notice directing the petitioner to show cause why Revenue Recovery proceedings should not be initiated for recovering the amount demanded in Ext.P7. It is for the petitioner to respond to the said W.P.(C).No.26142 of 2014 2 notice, to submit his explanation and to await the final orders that may be passed in the matter. Since no order to the prejudice of the petitioner has been passed till date, this writ petition is not maintainable.
In view of the above, the petitioner may submit his objections to Ext.P7. The first respondent shall consider the submissions, afford an opportunity of being heard to the petitioner, permit him to produce documents in support of his contentions, if any, and shall pass final orders on Ext.P7 in accordance with law.
