Heard Sri Deepak Kumar Tripathi, Advocate holding brief of Sri Ajay Kumar Mishra, learned counsel for the petitioner, Sri Tej Singh, learned Standing Counsel for respondents no.1, 3 & 4 and Sri Ten Singh, learned counsel for respondent no.2.
This writ petition has been filed with the following prayers:-
"i. An order or direction, directing and commanding to the respondent authorities to decide the representation of petitioner dated 11.05.2021 within stipulated period.
ii. An order or direction, directing and commanding to the respondent authorities to dismiss the vote counting dated 29.04.2021 and 02.05.2021 and assured for re-election process for fair and proper election within the stipulated time period."
It is contended by learned Standing Counsel that petitioner has an alternative remedy of filing an election petition under Section 12(c) of the U.P. Panchayat Raj Act.
In view of above, writ petition is dismissed on the ground of alternative remedy.
