Heard learned counsel for the petitioner and Shri Manoj Kumar Yadav for the Gaon Sabha, the respondent no. 3.
This writ petition has been filed seeking the following relief:-
"(I) Direct the respondent no. 2 i.e. Sub Divisional Magistrate, Tehsil-Machhalishahar, District-Jaunpur to decide the case no. 201814360303150 of 2018 namely (Nand Lal Vs. Gram Sabha) under section 116 of Land Revenue Code."
It has been submitted that the preliminary decree in the suit for partition under Section 116 of the U.P. Revenue Code, 2006 was passed on 19.06.2018.
On 23.10.2018, the Lekhpal was directed to prepare the lots. However, this report has not been furnished by the Lekhpal and, therefore, the final decree has not been prepared.
The writ petition is disposed of directing the court concerned namely the respondent no. 2 to ensure that the report and lots prepared by the Lekhpal are obtained, forthwith and thereafter proceed with the preparation of the final decree and to take the suit for partition to its logical conclusion, preferably within a period of four months from the date a certified copy of this order is filed before him.
