Counter affidavit filed by the State is taken on record.
Heard the learned counsel for the appellant and the learned AGA for the State on the first bail application in the instant criminal appeal moved on behalf of accused – appellant.
We have perused the judgment and order dated 05.07.2018 passed by the trial court convicting the appellant in S.T. No. 190 of 1995 arising out of Case Crime No. 51 of 1994, under Section 302, 201, 498A of IPC Police Station Mahabbatpur Painsa, District Allahabad.
We have heard the counsel for appellant at length. The appellant is husband of the deceased. As per the report of Doctor, the cause of death is smothering. In the opinion of doctor the girl was first smothered and done to death and thereafter she was put on fire.
Learned AGA has opposed the prayer for bail.
In view of the aforesaid facts and circumstances, we do not find it a fit case for bail. The bail application moved on behalf of appellant is hereby rejected at this stage.
