Heard learned counsel for the petitioner, Sri S.K. Gupta, learned counsel representing the respondents no. 2 and 4 and learned standing counsel who represents the respondents no. 1 and 3.
With the consent of learned counsel for the parties the writ petition is disposed of at the admission stage.
The sole of submission of learned counsel for the petitioner is that the petitioner is working as an Assistant Teacher in Prathemik Vidyalaya Ibraheempur Mirza, Block Bilari, District Moradabad. The petitioner suffers from incurable disease of cancer for which he needs regular treatment and medical add.
In this regard the petitioner has approached the respondent no. 2 and 3 for consideration of his transfer near NCR namely, Baghpat, Shamli, and Meerut etc. The writ petition is disposed of by directing the respondents to consider the petitioner's application sympathetically, in accordance with law and if the petitioner can be transferred a order be passed preferably within a period of two months from the production of certified copy of this order.
The petitioner is permitted to submit and elaborate representation and enclosing the copies of medical certificates/prescriptions etc., which will be considered by the respondent no. 2.
The writ petition is accordingly disposed of.
