Heard Sri S.N. Misra holding brief of Sri Harish Kumar Shukla, learned counsel for the petitioner and learned Standing Counsel for the State-Respondents.
The petitioner is an Assistant Teacher working in Jila Parishad Inter College, Nadigaon, Jalaun. He has sought transfer to another institution in Varanasi namely Sri Sankat Mochan Inter College, Singhpur Sarnath, Varanasi which is also an aided Intermediate College. The said transfer has been sought under the Regulation 55 to 59 of the Regulations framed under the U.P. Intermediate Education Act, 1921 It is submitted that the institution is agreed and its papers have been forwarded before the Director, Secondary Education where the matter is pending.
The writ petition is disposed of with the observation that in case the post upon which the petitioner is seeking transfer has not been requisitioned and the same is to be filled by direct recruitment, the claim of the petitioner be considered and appropriate order be passed by Respondent no. 2. The said decision shall be taken by the Respondent no. 2 within and period of three months from the date of presentation of certified copy of this order before it.
